7.2 What a Valid Takedown Notice Must Include
To be effective under the DMCA, your written notice must include all of the following:
- Your full legal name and contact information (address, phone number, email)
- A description of the copyrighted work you claim has been infringed
- The exact URL(s) on our Site where the allegedly infringing content appears
- The URL or location of the original work, to verify you are the rights holder
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf
- Your electronic or physical signature
7.3 Our Response
Upon receiving a valid and complete DMCA notice, we will:
- Remove or disable access to the allegedly infringing content promptly
- Notify the user who posted the content, where applicable
- Document the notice for our records
7.4 Counter-Notice
If you believe your content was removed in error, you may submit a counter-notice to our DMCA agent. A valid counter-notice must include:
- Your full name, address, phone number, and email
- Identification of the content that was removed and its original location on the Site
- A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification
- A statement consenting to jurisdiction of the federal district court in your area
- Your electronic or physical signature
Upon receipt of a valid counter-notice, we may restore the content within 10–14 business days, unless the original complainant files a court action.
7.5 Repeat Infringers
It is our policy to terminate, in appropriate circumstances, the accounts or access of users who are found to be repeat infringers of copyrighted works.
7.6 Abuse of This Process
Any person who knowingly misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages under 17 U.S.C. § 512(f), including attorneys’ fees.
